The 2 policemen have their hands full and cannot control the crowd, as they shout: What am I going to eat tonight? How can I pay my bills? Heckling the authorities in town hall and demanding that the Mayor come forth and address them.
When he does, they applause and demand that they be allowed to work, respectful of social distancing. Claiming their town is healthy and asking that the City Officials meet with a committee of citizens representing those who want the shut down to end.
If you keep the town shut down we are all going to go out of business and you wont have a city to govern, says their spokesman. He rightly points out that the Cura Italia decree will break the middle and lower classes.
The mayor responds by promising to speak to the regional authorities. But the crowd will not have it. They demand immediate action to reopen the businesses. Shouting, “We want to work”.

An English summary of this legal complaint

The legal complaint or Querela is a petition to the local Procurator or District Attorney, to begin a criminal investigation of the Italian Prime Minister, Giuseppe Conte — whose title is actually the President of the Council of Ministers.
The criminal complaint is written by Attorney Edoardo Polacco, who is an expert in Constitutional Law in the Italian Republic, and who resides here at Rome.
Attorney Polacco is distributing copies of the complaint in PDF so that Italian citizens all over Italy can present a copy of the complaint to the local prosecutor of their city, and ask that the same investigation be opened.
I, the author of this summary, Br. Bugnolo, will be signing a copy and presenting it also on Wednesday. I will attempt to interview Attorney Polacco live when he presents his copy at the Parioli Station of the Italian Carabinieri here at Rome, on Wednesday at 11 A.M.
The complaint charges the Prime Minister with the following crimes:
1. For the Violation of article 283 of the Italian Penal Code, the charge being “Attacking the Constitution of the Italian Republic”.
Article 283 reads:
Chiunque, con atti violenti, commette un fatto diretto e idoneo a mutare la Costituzione dello Stato o la forma di Governo, è punito con la reclusione non inferiore a cinque anni.
Which in English, would be:
Whoever, with violent acts, commits a deed directed and suitable to change the Constitution of the State or the form of its Government, is to be punished with imprisonment for no less than 5 years.
The charge is moved by Attorney Polacco on the grounds that without proper due form of law, parliamentary approval and authority, Giuseppe Conte and his government has attempted to act in direct violation of no less than six articles of the Italian constitution:
- Article 13 which guarantees as inviolable the personal liberty of each citizen.
- Article 16, which guarantees to each citizen the right to travel and dwell freely in any part of the territory of the Republic.
- Article 19, which guarantees to each citizen the right to practice publicly or privately his own religion.
- Article 20, which guarantees that each institution of the Church is exempt from being subjected to any law which specifically and uniquely targets it.
- Article 25, which guarantees for each citizen due process of the law, and forbids expressly that any citizen be punished by any non-legislative measure.
- Article 33, which requires that all students be promoted only on the basis of passing a standardized test.
2. For the violation of Article 323 of the Italian Penal Code, the charge being “Abuse of office”
This charge is moved on the basis that the Prime Minister by decree attempted to institute criminal penalties without seeking legislative approval by the Italian Parliament
3. For the violation of Article 610 of the Italian Penal Code, the charge being “Violence against Citizens”
This charge is moved on the basis that the Prime Minister ordered the various Italian police authorities to stop, arrest, seize, hunt, imprison and fine citizens without any constitutional authority for the violation of a measure which was not sanctioned by the law.

Questions Answered
I turn now to apply the principles noted above and answer some of the questions we have received.
1. Does a diocesan bishop have the authority to cancel “non-essential” activities in a parish, such as Stations of the Cross, CCD, bible studies, etc.?
Generally speaking, no. A pastor is the administrator of his parish. Under jurisprudence, it is the pastor, not the bishop, who can set Mass schedules. I have won and lost cases because of that jurisprudence. That being true, it would be the pastor, not the bishop, who is entrusted with making decisions about what is essential and what is not. He should do so with guidelines from the bishop, but not prohibitions. This is the principle of subsidiarity at work. The pastor should also prudently weigh the circumstances, risks and benefits associated with his decision.
2. What are the canonical issues involved with a bishop shuttering churches and suspending all public Masses?
For a bishop to do this, he must issue a decree that is motivated in fact and specific to the circumstances he is addressing. The decree must be properly promulgated and thereby actionable; that is, open to challenge. More at issue is that the faithful have a Divine Law right to the sacraments. Personally, I do not believe such a directive is legitimate but the circumstances for appeal would be too burdensome and probably not resolved until after the pandemic has passed. For this reason, the Faithful are encouraged to find other, more favorable ways to obtain the sacraments while also petitioning their bishop to provide the sacraments. The Faithful should also use acceptable means to persuade a bishop to allow public Masses with prudent measures implemented.
3. What canonical arguments exist in favor of a pastor continuing to celebrate the sacraments for his people?
See #2 above. The vocation of a pastor is to minister to the spiritual needs of his people out of the Word of God and the Sacraments. Just as a parent’s obligations to children are not suspended when a crisis occurs, neither is a pastor’s. The Faithful have a right to receive the sacraments, and this places an obligation on a priest to provide them. In danger of death, the obligation to provide is extended to those priests who no longer have ordinary faculties.
4. Can a person be required to receive Holy Communion in the hand during the Coronavirus?
No, not legitimately. This will be disputed, and the person refused Holy Communion will likely not see a decision in their case until after the crisis is past. A greater concern is that such refusal will become normative. If a person is refused Holy Communion on the tongue, that person will be faced with a hard decision to appeal or not. The SJF is ready to assist anyone in making that discernment.
5. What is necessary to confect the Eucharist, as opposed to what may be in the rubrics or a part of custom?
As per any sacrament, to confect the Eucharist requires valid matter, form, and intention. For the Eucharist, valid matter is unleavened bread (in the Latin Church and most Eastern Catholic Churches) and pure grape wine. The form is the words, “This is My Body” and “This is My Blood” said at the appropriate time. The priest must intend to confect the Eucharist. The “breathing” on the species during consecration is a beautiful custom but is not obligatory. Consequently, a priest who wears a mask during the celebration of Mass, or distributes Holy Communion with gloves, or uses other precautions that do not affect the matter, form or intention, do not harm the validity of the Mass. Such precautions should be taken in collaboration with the bishop.
6. Can a priest use soap or hand sanitizer during the purification of his hands during Mass?
The rubrics call for water. Adding lemon juice or even isopropyl alcohol to the water as a disinfectant would not, in my opinion, affect the liceity of the act. Doing so would be far less offensive to the rubrics than wearing gloves to distribute Holy Communion, which itself could be reasonable during this crisis.
7. Can extraordinary ministers be used in lieu of the presiding priest so the priest can remain socially distant and lessen the risk of being exposed to the virus? Can extraordinary ministers self-communicate for the same reasons?
Yes to both. These measures should be taken in collaboration with the bishop, but if such collaboration is not possible, a presiding priest can make those decisions in extraordinary circumstances. None of those examples affect the validity of the Sacrament.
8. Should a priest disobey his bishop if his bishop orders that all public sacraments are to cease?
This is a tricky question for some and easy for others. The answer should not be taken lightly. A priest vows obedience to his bishop, so the question behind the question is, “What is the obedience he vowed?” As a virtue, obedience flows from Justice. It is giving to authority what is due that authority. As Christians, all of us must be obedient to lawful authority. It’s part of what we believe. On the other hand, all authority has limits, and the first limits that must be respected are the limits imposed by Faith and Morals. When that authority acts in a manner contrary to Faith or Morals, we have no obligation to obey. He may have the power to act, but such acts are illegitimate insofar as they violate Divine Law, either Positive or Natural. The right of the Faithful to receive the sacraments is a matter of Divine Law. Whether providing them at a particular time is appropriate or not is something the minister of that sacrament must determine at that time. If a bishop prohibits the public exercise of sacraments during this crisis, and a priest has concerns, the priest should prayerfully consider the circumstances of the prohibition as they relate to him and the people under his care. He must consider the norm of Canon 18 and other applicable laws, what faculties the Church provides, what opportunities for grace exist for the people, and what his options are. He should express his concerns to his bishop, even asking the bishop to reconsider if necessary. If he chooses not to obey the directive, he must be certain in his conscience that he is being obedient to God. Put another way, a priest should always obey a legitimate directive from his bishop.

It continues to deny the right of Catholics to worship, except at funerals of 15 persons or less.

Ssiamo stati spiati, soggiogati, trattati come delinquenti da un governo che in due mesi ha distrutto i nostri diritti fondamentali naturali e costituzionali. Il parlamento si è fatto sostituire dalle varie task force che hanno commissariato di fatto l’italia alle lobby colleghi, internazionali colleghi.
L’abilità della stazione di fu del bombardamento mediatico sono stati usati come mezzi di propaganda per condizionare le menti degli italiani facendo leva sulla loro atavica paura di morire e censurando chiunque osi alzare la testa e denunciare questi abusi.
Vi siete dovuti mascherare per non farmi riconoscere dagli italiani che ben sanno che siete responsabili di questa emergenza. Ci sono tutti in questa aula: il centrodestra del modello azienda veneto 0 di saia e Mantuan che negli ultimi 10 anni ha cancellato il 40 per cento dei posti letto in terapia intensiva così come la cosiddetta sinistra che con il suo Zingaretti ha fatto da perfetto esecutore delle politiche neoliberiste predatorie degli ultimi trent’anni speculando come sciacalli arricchendo i privati in attesa della guardia di finanza che evidentemente in questi in queste ore è già negli uffici della Giunta Laziale.
Zingaretti poi prendendo esempio dalla campagna vaccinale Lombarda che ha causato i disastri che oggi paghiamo ha ben pensato di imporla anche nel Lazio pur sapendo che esistono già ampie evidenze che le vaccinazioni antinfluenzali porta colleghi e in 40 per cento dei casi covi di in più per interferenza virale come se non si sapesse che coronavirus a un cofattore quindi indicatori di altre criticità ambientali l’inquinamento: anzitutto anche quello elettromagnetico con i suoi effetti nocivi tardis colleghi perché i cantieri delle antenne come quelli anche delle grandi opere da nord e sud d’italia non si sono mai fermati per il Covid. Chissà come mai?
Ed allora nel pieno segue di questo scientismo della Santa Inquisizione da salotto televisivo si possono sacrificare il personale militare, i poliziotti, personale medico, i nostri figli, i nostri anziani alle sperimentazione di un vaccino che sappiamo e lo sanno anche i sassi non servirà a nulla per la punto evollezza del virus.
Il tutto ovviamente avallato da questo Movimento 5 Stelle che abbiamo visto anche oggi essere in piena crisi d’identità ma che resta attaccato alle sottane del PD tradendo tutte — dico tutte le promesse elettorali — in cambio di qualche poltrona, impegnato forse troppo legame di Tallinn.
Chiudere colleghi: neste ingiustizie levino nella Giunta Laziale. Ccomplimenti! Se non fossimo in un paese democratico ci sarebbe da pensare male ma veramente male!
Tutti questi DPCM sono incostituzionali. Lo sappiamo bene: sono il simbolo dell’autoritarismo dal regime sanitario mediatico smacchiato col rosso sangue dei nostri diritti naturali costituzionali altro che 25 aprile.
La storia non perdona, Presidente, ed un giorno molto presto dovete spiegare perché avete sacrificato l’Italia, la nostra carta costituzionale, sottomettendoci ai giochi nel geopolitici tra gli Stati Uniti e Cina, lasciando che questo paese divenisse territorio di nuove guerre fatto certamente con il virus, e svendendo tutte le nostre informazione, anche quelle più private e intime al miglior offerente.
E allora mi rivolgo a Lei, Presidente, e alla relatrice Lorenzin, tanto cara già al popolo Italiano, e ho un messaggio da parte di tutti Italiani che non ci stanno che vogliano farvi vedere cosa se ne faranno di tutti questi provvedimenti inconstituzionali!

All these DPCMs are unconstitutional. We know this very well: they are the symbol of authoritarianism from a mass-media health regime stained with the red blood of our natural constitutional rights far beyond those of April 25.

But I was inside, I opened the door and they entered, astounded at the door’s opening of itself. I was standing aloof where they could not see me. There was no service, only the chancel-lamps were burning, and the people knelt in quiet prayer. Then the Mother of God appeared.
